This document (hereinafter — the “Disclaimer”) establishes the terms of access to and use of the websites https://www.horsecare.si, https://horsecare-int.com/, https://account.horsecare.si/ (hereinafter — the “Website”), the HorseCare software and mobile application (hereinafter — the “Software”), as well as the HorseCare equipment (hereinafter — the “Equipment”).

For the purposes of this document, “Company”, “we”, “us” shall mean the owner and operator of the Website, Software, and Equipment.

By using the Website, Software, or Equipment, the user (hereinafter — the “User”) confirms that they have read, understood, and fully accept the terms of this Disclaimer. In the event of disagreement with any provision, the User must immediately cease using the relevant services and products.

1. Legal Status and Purpose of the Equipment and Information

1.1. Informational Nature
The HorseCare system, including the Equipment and Software, is intended solely for the collection, processing, visualization, and analysis of horse movement data and does not constitute a source of professional advice.

1.2. No Medical or Veterinary Purpose
The Equipment and Software are not medical or veterinary devices and are not subject to regulation under, inter alia, Regulation (EU) 2017/745 (Medical Devices Regulation) and Regulation (EU) 2019/6 (Veterinary Medicinal Products Regulation).

They are not intended and must not be used for the diagnosis, prevention, monitoring, treatment, or alleviation of diseases or pathological conditions.

1.3. No Professional Advice
Any information, data, analytical materials, notifications, or recommendations provided by the system do not constitute veterinary, medical, or other professional advice.

1.4. User’s Independent Decision-Making
The User bears sole and full responsibility for:

  • interpretation of the obtained data;
  • decisions related to the health condition of the animal;
  • selection of treatment, training, or care methods.

The Company strongly recommends consulting qualified veterinary professionals before making any decisions that may affect the health of the animal.

1.5. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Company provides no express or implied warranties, including but not limited to:

  • accuracy, completeness, or timeliness of data;
  • uninterrupted or error-free operation;

All services, data, and Equipment are provided on an “as is” and “as available” basis.

2. Limitation and Exclusion of Liability

3.2. General Safety Requirements
The User acknowledges and agrees to comply with the following requirements:

  • the Equipment contains electronic components and batteries and is not intended for ingestion;
  • it is prohibited to open, modify, or subject the Equipment to mechanical impact;
  • installation and attachment must be carried out exclusively using designated fastening elements;
  • use of the Equipment in ways not предусмотрены by the instructions is prohibited;
  • it is strictly prohibited to insert the Equipment into natural body openings of an animal;
  • the Equipment is not intended for use by children and must not be used as a toy.

3.3. Liability for Improper Use
The User bears full responsibility for any consequences resulting from violation of these requirements, including damage, injury, or malfunction of the system.

4. Governing Law and Dispute Resolution

4.1. Governing Law
This document shall be governed by and construed in accordance with the laws of the European Union, as well as the laws of the country of registration of the Company.

4.2. Dispute Resolution
All disputes arising out of or in connection with this Disclaimer shall be resolved by the competent courts in accordance with applicable jurisdiction rules.

4.3. Consumer Rights
Nothing in this document shall limit the User’s rights as a consumer granted under mandatory provisions of European Union law and applicable national legislation.

5. Acceptance of Terms

By using the Website, Software, or Equipment, the User confirms that:
